TERMS & CONDITIONS

PLEASE READ THIS IN FULL BEFORE SENDING ANY DEPOSIT SO THAT THERE IS NO MISCOMMUNICATION, BY SENDING A DEPOSIT YOU ARE AGREEING TO EVERYTHING ENTAILED IN THIS DOCUMENT.

 

All Automaniac Services Ltd. (AMS Recovery Trucks) Of Wisbech, Cambridgeshire (the company) products benefit from manufacturer aftersales support for a period of 12 months / 365 days from date of invoicing or collection whichever comes last. Items suffering from defective manufacturing processes or materials will be replaced by the company in accordance with statutory protection afforded under law. All manufacturing defects will be fixed free of charge within our warranty period at our site in Wisbech, PE13 2GB. We take great pride in our work and we aim to build every product to the highest standard. Over 95% of our vehicles do not come back in the first 12 months for any warranty work whatsoever. If any manufacturing issues occur we will fix this as soon as possible and at a convenient time for you. Warranty claims which are found to have been because of accident damage, misuse, evident lack of maintenance or required adjustments, will not be upheld. We have a dedicated service department who can handle a booking and make this service as efficient as possible. To present any warranty claim this must be booked in with our service department prior and a suitable time slot will be given. We will have a member of staff ready to work instantly once the vehicle arrives to ensure the most efficient service is provided. We completely reserve the right to refuse to inspect a vehicle if you present the vehicle late compared to the time slot booked. If the vehicle is more than 60 minutes late without any prior knowledge of this happening, we reserve the right to cancel this inspection and will require a £100 non-refundable deposit on the next booking and going forward on any bookings whatsoever. Alternatively if we have a member of staff still free this can be paid via the office team and we will resume any warranty work at the new arrival time. You understand fully before making the booking this is our terms.

 

If purchasing a whole Motorised vehicle from AMS, you understand any manufacturing issues with the Chassis are not something Automaniac services Ltd. Are responsible for whatsoever.This is the responsibility of the Manufacturer of the vehicle, and you are fully aware of the manufacturer's warranty period. All vehicles unless stated are brand new and unregistered. This means the manufacturer warranty is in place from the day you purchase. You have researched the manufacturer warranty and understand this before purchasing. All registration details are passed to the supplying dealer of the brand new vehicle. It is not our responsibility to register a vehicle correctly or have it registered correctly. You are responsible for sending the correct details for registration and if these are different to the invoicing details we need to know straight away. We send the relevant paperwork over to the dealer and our commitment ends at this point. You understand AMS only are responsible for the warranty of the recovery body. You are also fully aware and have the relevant licenses/insurance to drive the vehicle you have purchased. Under no circumstances is Automaniac Services Ltd. Liable for this. AMS is not the DVLA/DVSA, you need to make sure you fully understand the relevant license to drive the vehicle you have purchased as this is not the responsibility of AMS whatsoever. You are also fully aware of any current legislation you may be required to understand for the type of work you plan to undertake with the vehicle/body.

 

Depending on the nature of the claim, the company reserves the right when presented with a claim under its warranty policy to refer to its experience, know-how, and understanding of the evidence when deciding on warranty approval. The company's decision will be final. The company sells its product solely on site at Wisbech, no other agents sell our vehicles officially nor do we endorse anybody who does. If other agents are selling our vehicles, then any warranty claims would be with themselves, To be considered as valid, customers must present all warranty claims to ourselves on site in Wisbech. If you purchase a vehicle from anybody else except AMS, this will not be covered by any warranty whatsoever by AMS. You have a contract with the supplier themselves.

 

If the vehicle is being used for short/long term Hire to other members of public/businesses, we are in no way responsible whatsoever for any costs incurred for warranty claims and vehicles being taken off an end user. This is something AMS will never cover. This is a matter of having other relevant insurance for this purpose and not the responsibility of AMS. We will also never transport these vehicles back to AMS for any warranty work whatsoever. We will never offer to do this and is the responsibility of the owner to bring back. Every vehicle must come back to AMS for warranty work, no exceptions.

 

When buying this vehicle/body you understand the relevant distance between your place of work and where we are located in Wisbech. You agree that this is something you understand, and all warranty work is to be undertaken here. You are happy to transport vehicle to us so that we can undertake warranty work. You fully understand that it is not the responsibility of AMS Recovery trucks to present a warranty claim to the site in Wisbech of a sold vehicle under any circumstance whatsoever.This is completely down to the owner of the vehicle. There will be no reimbursement whatsoever of any form to cover this in any scenario.

 

By purchasing this vehicle, you understand it is your responsibility completely to make sure every person using this vehicle understand how to use it and how to load/unload vehicles or goods. This is not something to be undertaken by somebody who is not qualified at any time whatsoever.You have all relevant qualifications, and it is not our responsibility to make sure you have these. You also completely understand that any damage caused by misuse is not covered by warranty. It is not covered under any circumstance. Also, we can only offer guidance on how these vehicles are meant to be used. Every circumstance is different when recovering vehicles for example so you should have the know how or members of staff should to use the vehicles effectively without causing damage to the bodywork AMS has completed.

 

We offer a free body health check on all bodies built by AMSO This is required to take place before the first 12 Months (whichever comes first) of the vehicle leaving our premises. This is to take place here at our site in Wisbech. This is intended to make sure everything manufactured or fitted by ourselves is operating and effective as when it originally left our site. By not taking advantage of this free Health Check, it may invalidate future claims in the 365- day period due to this being a time to spot and resolve these issues before they become more serious and cause damage.

 

Body warranty.

The company provides a unique warranty period of 12 Months in relation to the longevity and integrity of the body/trailer, subject to exclusions, based on the following conditions:

  • The Product purchased has never been overloaded at any time. The weight restrictions have been always adhered to without any doubt. Evidence of such a condition may be that the components have been twisted as opposed to have broken. We reserve the right to do our own research on how the vehicle has been used. We may use facilities such as social media to see how a vehicle has been used and if found that a vehicle has been misused (overweightfor example), we will invalidate any warranty period whatsoever. Before purchasing this Vehicle/ Body/ Trailer you fully understood the relevant laws. Any proof of failing to comply from yourself will make the warranty void. Examples of failing to adhere to laws.

  • Incorrect distributed weight, overloading, excessive speed and towing speed, towing by an unqualified driver, and using with broken key parts of the vehicle (flat tyre, poor condition brake disks, vehicle not serviced on time).

  • The product has never been involved in an accident at any time. Accidents, even some time ago, can lead to weakening of components and subsequent failure.

  • The product we provided has never been modified from the originally supplied design. If modified in any way we will not cover any component failure.

 

And subject to the following conditions being met:

  • The date of first claim is less than 12-months from the date of original invoice. We should be aware of any issues whatsoever before the 12-month period if there is any.

  • The vehicle must be presented to us within the 12 Month period also to be rectified. The claimant is the original purchaser.

  • The warranty is non-transferrable. If a vehicle it has been road worthy throughout the whole warranty period and serviced according to manufacturer's specification.

  • A product is presented for rectification at the company's Main site in Wisbech, UK. PE13 2GB.

If vehicles have been tampered with by yourself or another repair business, we reserve the right to suspend our warranty completely. This is due to other businesses doing work incorrectly and then us having to fix the issues they have created. If worked upon by anybody else the warranty shall be void. All warranty work must come to our AMS site in Wisbech.

 

Vehicles with Hydraulic moving parts/cylinders (Tilt and slide / Speclift / SLA Etc.)

All vehicles with any Hydraulic moving parts/cylinders and PTO fitted require work by the user daily to maintain and be safe for use on the road. THESE HAVE TO BE CHECKED DAILY, NO EXCEPTIONS. This is not only to uphold the warranty but also so that the vehicle is safe for use on the road. There should be a daily inspection on the bed of the vehicle making sure to see that all moving parts and nipple points have sufficient grease, A full overall body check including a full inspection to see if there is any damage to any cylinders, hoses, valves, steel or alloy welds and panels must be undertaken. There are also some serviceable parts what must be maintained on a schedule.

 

  • Oil Return Filter and Air breather Filter must be replaced every 3 months.

  • Hydraulic oil in tank must be replaced every 12 months under standard use / 6 months under heavy recovery use.

If there is any damage or serviceable parts above are not performed the vehicle must be taken off the road and repaired / brought back for warranty work if required,

Payments

NO VEHICLE IS OFF SALE / BODY IS BOOKED IN UNTIL A DEPOSIT IS PAID, NO EXCEPTION. WE HAVE THE RIGHT TO SELL ANY VEHICLE UNTIL A DEPOSIT IS TAKEN. OUR CONTRACT ONLY BEGINS ONCE A DEPOSIT IS PAID. We accept only Bank transfer via BACS unless otherwise specified and agreed before any deposits are taken.

 

INVOICING TERMS

Chassis and Body purchased together only

When purchasing a Vehicle from AMS (Chassis and Body) it is your responsibility to have funds ready to pay once the vehicle is complete, Unless otherwise agreed and in writing you have 14 Days from the invoicing date/completion of vehicle date whichever comes first to Pay for the goods in full. It is also your responsibility to make sure if any finance providers are involved to pay within this time frame also. We reserve the right to charge a stocking charge after this period of 14 days at a rate of 25% APR interest per annum plus a £150 Plus VAT admin charge for the time wasted by our team chasing for the vehicle to be paid or collected or both. Interest will be accrued daily and will only complete once full payment be in the hands of AMS. Interest is charged on the full invoice amount including VAT. This is to be paid additionally after any funds have cleared into the bank account. No vehicle will leave our premises without the original invoice plus any charges if applicable being paid and clear funds in our bank account. Once an order has been placed, we recommend to every customer to start organising funds/finance to be in place ready for once the vehicle is complete. We do not recommend whatsoever doing this only when the vehicle is complete. Unless otherwise agreed and on the estimate/invoice this is our terms of business. If you request an invoice before the vehicle is completed to arrange funds, we reserve the right to void this after a 14 day period if not paid and reinvoice with the new relevant date. Body only customers When purchasing any form of body from AMS it is your responsibility to have funds ready to pay the final invoice immediately. If a purchase order is required for payment, you have ensured our sales team have this the moment the vehicle lands. Before making a booking or dropping a truck off you fully understand once the vehicle is complete it will be invoiced, and payment is required within 7 days. Once payment is received, we can allow another 7 days for collection. If the vehicle is not paid / collected within the time frames above, we reserve the right to charge a Stocking charge of 25% APR interest per annum and a £25 parking charge per day (including weekends). All charges are on the full invoice amount and Plus VAT. If any of these charges are to be enforced there will also be a £150 Plus VAT admin charge for the time wasted by our team organising payment or collection or both. All charges will be invoiced separately and we will write or call you in regards to this once they begin accruing. No vehicle will be released without full payment of original invoice and additional charges if applicable. This is non negotiable and fully understood before any vehicle is dropped off. Under no circumstances will AMS invoice a body to any finance company or third party either. The body will be invoiced direct to the company/private individual only unless agreed beforehand and in writing.

 

CANCELLATIONS

PLEASE SEE OUR BELOW ON CANCELLATION CHARGES, BE MINDFUL THAT WHEN ORDERING WE ARE MAKING A CUSTOM BODY TO YOUR SPECIFICATION. THIS COSTS US El OOO's IN PREPERATION AND MATERIAL ETC. NOT ONLY THIS IT TAKES A VEHICLE OFF SALE WHICH COULD BE SOLD ELSEWHERE.

 

  • 3.5 TONNE FULL BODY ALL EXTRAS/OPEN CENTRE BODY ALL EXTRAS: £1,000 CANCELLATION CHARGE

  • 3.5 TONNE CUSTOM BUILD: £500 CANCELLATION CHARGE

  • 5 TONNE FULL BODY ALL EXTRAS: £2000 CANCELLATION CHARGE

  • 7 TONNE TILT AND SLIDE/TWIN DECK/ SPECLIFT; FULL VAT DEPOSIT CANCELLATION CHARGE

 

THIS CHARGE WILL BE TAKEN OUT OF ANY DEPOSITS PAID.

ALL ITEMS BELONG TO AUTOMANIAC SERVICES LTD UNLESS ALL PAYMENTS ARE FULLY CLEARED AND IN OUR BANK ACCOUNT. NOTHING LEAVES OUR WISBECH UNTIL THIS HAS HAPPENED.
